He's Remarkable Hearing For Leave Of Appeal On January 24

Connections of He's Remarkable, who lost the Gr. 1 Railway Stakes in Perth on protest a month ago, will learn later this month whether they can appeal the decision.

The owners of the New Zealand horse will seek leave before the Racing Penalties Appeals Tribunal in Western Australia to appeal the stewards' decision to relegate He's Remarkable to second in the A$1 million feature. The hearing will take place on January 24.

The Roger James-trained He's Remarkable was first across the line in the Railway Stakes on November 19 but lost the race to Luckygray on protest as stewards determined interference at the 600-metre mark had been caused by He’s Remarkable and had cost the runner-up victory.

James was shocked by the stewards' finding, while a Group One victory would have a major impact on He's Remarkable's future at stud. That view, given the apparent evidence, was shared by many on both sides of the Tasman.
